Should I tell a potential construction employer about my criminal history from 7 years ago before they conduct a background check?

Protections will vary from state to state, but generally speaking, a prospective construction executive is not required to disclose any information concerning an arrest or criminal charges that did not result in an actual conviction. In an industry such as banking or finance, however, it will not be considered unusual for the employer to conduct a criminal record background check when pre-screening construction job seekers. Depending on the state law where you reside, the employer may need to advise you and other construction job seekers that your criminal records will be checked as part of the hiring process, thus the construction employer will need to obtain written authorization for your release of such records.
